1. General Terms and Conditions All services provided by Eskhosting (hereinafter referred to as the "Service") provided to the customer (hereinafter referred to as "User") under the conditions set forth in this Service Agreement. Service Agreement is a comprehensive and final agreement between the User and the Provider and constitutes the rules and regulations to use the services of the Provider.
Please read this agreement and make sure you understand all of its points and agree with them. The agreement for the provision of services by the Provider assumes that the user agrees to the provisions set forth in this Service Agreement and all other rules and regulations adopted by the Provider and published on the official web site of the Provider. This Service Agreement will be governed by the laws and legislative acts of the physical location of the web servers of the company (Germany, USA), the country of registration of legal entities Provider (Hong Kong), as well as international laws and regulations, adopted and in force in the field of web hosting and domain name registration.
The following provisions are intended to ensure the maintenance level of service provided by the Provider at the highest level, to provide for the availability of appropriate warantees and respect the rights of Users.
Provider is the sole arbitor in respect of all those facts which can be regarded as a violation of any provision of this Agreement. Provider allocates to the User a space for the physical placement of data on servers residing on the Internet, in accordance with the tariff plan chosen by the User during his chosen period of time.
Provider is not liable for User not being able to use web hosting account for its intended purpose (placing files on the server site), does not track such accounts and does not keep records of time, when the user files of the site were or were not placed on the server. The service in this case is provided to the User and transferred funds are non-refundable.
Adult content is forbidden.
2. Adequacy of information.
When ordering a web hosting account and during account activation the User must provide adequate, true, accurate and complete information about himself in order to properly register a domain name / web hosting plan and in order to ask all questions about his services/contact Provider`s support team.
The provider has the right to suspend and / or to refuse to provide services if there is reason to believe that data provided is incomplete or not truthful and / or request a scanned copy of the original document confirming the identity of the User to verify the data provided.
From the moment the account is activated and the user's domain name is registered, in accordance with the agreement of the domain name registration, the User is obliged to update and change his contact information, if any, changes have taken place. Thus, the Provider will be able to properly monitor the user's account (such as sending notifications or checking the validity of user contact information). The user has the ability to edit his contact information with the hosting account control panel https://user.eskhosting.com. If the User wants to change the contact email address for the web hositng account he should to send a ticket or a letter from a current registration e-mail address to support service. To change the contact details of domain owner, User must also send a support request to the Provider via User`s control panel or from customer registration e-mail address.
If the user orders a web hosting service on behalf of another person, you need a clear understanding of the fact that he represents another person and, therefore, the User must provide accurate contact information on the person, which is user so that Provider has the opportunity to confirm the accuracy of information provided anytime when its needed. The owner of the account is the person in whose name account has been ordered, regardless of the data owner of the domain / domains hosted on your account. The reason for validation of the account owner is the identification document of the account owner.
Provider reserves the right to terminate, suspend any part of the account (either domain registration or web hosting services), or the whole user account and do not create it at all, if any part of the information provided by User is inaccurate, outdated or incomplete. Provider reserves the right to use the remedies to those users who intentionally provide false information, posing as other people, thereby violating the above requirements.
3. Payment for services.
The user agrees to the fact that when you create a hosting account, he transfers the funds to the Provider by chosen method of payment in the amount equal to the cost of services: User choses hosting plan and payment period, and the domain name. Funds are withdrawn at the time of the creation account as a prepayment for the entire period of the hosting plan. The minimum period of the hosting account is a calendar month, partial payment for a minimum period of 1 month or payment by number of days (7 days, 20 days, etc.) is impossible.
Account is activated after funds have been transferred to the Provider account, the test period when activate account is being activated without advance payment is not provided.
The user agrees to the fact that when he creates a hosting account, he transfers the funds to the Provider by chosen method of payment in an amount corresponding to the value of the web hosting plan for the chosen period. In the case when User orders both web hosting services and domain name registration, the calculated value is added to the cost of hosting services.
